But the nine member bench, headed by chief justice Luke Malaba unanimously ruled against Chamisa citing lack of evidence.

The Constitutional Court this week ruled against the opposition MDC Alliance after it approached the court, saying it has evidence that the election was rigged.

On August 2, Zec announced that Mnangagwa had garnered 50.8 percent of the total vote, with Chamisa taking 44.3 percent.

MDC had insisted that its candidate Nelson Chamisa won the November 30 presidential election, arguing that the president (first respondent) had benefitted from irregularities in the voting process.

"There has been a massive doctoring of evidence", Thabani Mpofu, a lawyer representing the MDC, told the top court when it started sitting on Wednesday.

The elections were largely judged to be free of the violence which characterised previous elections in Zimbabwe.

Chamisa acknowledged that, with the Constitutional Court's decision, "the legal route has come to a dead end".

Finance minister Patrick Chinamasa told Reuters that Mnangagwa would be inaugurated on Sunday.

After Mugabe's ouster, his ruling party, the Zimbabwe African National Union-Patriotic Front, retained power and Mnangagwa slid into Mugabe's seat.

Diplomats accredited to Zimbabwe are also being invited for the inauguration.

Chamisa insists he won more than two-thirds of the vote.

The spokesman says inauguration preparations can not begin before the court ruling and "that is a problem". It will now take place on Sunday.
