NY is accusing Charter of failing to meet its commitments have led to the move.

In the meantime, Charter must comply with all local franchises it holds in New York State and all obligations under Public Service Law and commission regulations.

On Jan. 8, 2016, the PSC approved Charter's acquisition of Time Warner.

In approving the transaction, the commission stated that the merger must yield positive net benefits, after balancing the expected benefits properly attributable to the transaction offset by any risks or detriments that would remain after applying reasonable mitigation measures. NY is also seeking $3 million dollars in penalties from Charter.

The commission said the USA broadband provider failed to live up to its agreement as part of the merger to build internet access to an additional 145,000 households and businesses in rural areas of NY under-served by internet providers. Although Spectrum says it made its network available to over 86,000 residents, NY was planning on 145,000 businesses and homes being serviced. As a result of Charter's adamant refusal to abide by the conditions of the merger approval, the Commission ordered Charter to develop a transition plan. But the company must ensure that cable and internet customers' service is not interrupted during the transition to a new provider, the commission said.

"Its failure to meet its June 18, 2018 target by more than 40 percent is only the most recent example." the Commission adds.

"Charter's non-compliance and brazenly disrespectful behavior toward New York State and its customers necessitate the actions taken today seeking court-ordered penalties for its failures, and revoking the Charter merger approval", Spectrum provides cable, internet and telephone services to more than 2 million New York subscribers in Manhattan, Staten Island, Queens and parts of Brooklyn, as well as other major metropolitan areas like Buffalo, Rochester, Syracuse and Albany.

New York State officials announced Friday they are taking steps to remove cable service provider Charter Spectrum from the state.

UPDATE: Charter told Ars that it plans to fight the PSC's order to sell the former Time Warner Cable system. It also promised to upgrade broadband speeds to 100Mbps by the end of 2018, and 300 Mbps by the end of 2019 throughout its service area.
