An announcement will be made during a press conference at 10 a.m. Tuesday.

After informing Sterling's family about his decision, Attorney General Jeff Landry told reporters that there was not enough evidence of criminal wrongdoing to bring charges.

"The Louisiana Department of Justice can not proceed with a prosecution of either Officer Howie Lake or Officer Blane Salamoni", Landry told reporters after meeting with members of Sterling's family in private. Sterling, 37, had been selling CDs outside a convenience store when he was approached by two officers, Blane Salamoni and Howie Lake II, responding to a call about a man who had threatened someone else with a gun.

Racial tensions were still simmering in Louisiana's capital when a 29-year-old black military veteran shot and killed three Baton Rouge law enforcement officers on July 17, 2016.

When Sterling spun around and pulled his right arm away from Salamoni, Salamoni drew his gun and said, "Don't f****** move, or I'll shoot you in your f****** head", the report says.

Sterling's death in Baton Rouge was one of a number of killings of black men by white officers that helped fuel the Black Lives Matter movement and raised questions about racial bias in USA policing.

Veda Washington-Abusaleh, Sterling's aunt, was in tears after meeting with Landry. Landry said it was "reasonable" to conclude Sterling was under the influence of drugs during the struggle with the officers "and that contributed to his non-compliance" with the officers' commands.

Two cellphone videos of the shooting quickly spread on social media, leading to nightly protests during which almost 200 people were arrested.
