Hannity: 'It Was San Francisco's Sanctuary City Policies That Killed Kate Steinle'

Hannity: 'It Was San Francisco's Sanctuary City Policies That Killed Kate Steinle'”

The jury reached a verdict in six days and convicted Garcia Zarate of possessing a firearm but found him not guilty of assault with a firearm.

Zarate had been deported five times and was wanted for a sixth deportation at the time of Steinle's death.

President Trump weighed in on the acquittal in the Kate Steinle murder case. The fact that San Francisco Sheriff's Department, months before the shooting, had refused to tell federal immigration officials when undocumented Garcia Zarate was to be released from jail made it a touchstone in the national debate on sanctuary cities. "This tragedy could have been prevented if San Francisco had simply turned the alien over to ICE, as we requested, instead of releasing him back onto the streets". But Zarate's defense attorney contended the shooting was accidental.

EMSLIE: Yeah. So they found not guilty on nearly all of the charges that the defendant faced with the single exception of being a felon in possession of a handgun.

"Her death was preventable - and it should have been prevented", Attorney General Jeff Sessions said in July. While U.S. Immigration and Customs Enforcement had issued a detainer for Zarate, he was released under the city's sanctuary laws. The defense had argued that the incident was a tragic accident, and that the gun Garcia Zarate, 45, was holding discharged accidentally and the bullet ricocheted for 78 feet before hitting Steinle.

President Donald Trump's son, Donald Trump Jr. responded to the verdict and tweeted out saying: "What a disgrace".

In an interview with local media, Zarate said he had made his way to San Francisco because he knew he would be less likely to be deported because of the city's sanctuary policies. City officials have said they're not liable for a former inmate's actions. The maximum sentence he faces is three years, according to a detailed report on the outcome from Vivian Ho at the San Francisco Chronicle. "I have met with numerous great parents who lost their children to sanctuary cities and open borders". "This is an absolutely disgraceful situation and I am the only one that can fix it".

Trump also mentioned Steinle in his acceptance speech at the Republican National Convention after winning the Republican presidential nomination.

In June, the House of Representatives passed "Kate's Law", a measure named for the victim that would increase maximum prison penalties for immigrants caught repeatedly entering the United States illegally.
