Intel scores victory in fight against €1.06bn AMD antitrust fine

Intel scores victory in fight against €1.06bn AMD antitrust fine”

USA chipmaker Intel's decade-long fight against a 1.06-billion-euro ($1.3 billion) European Union antitrust fine is set to drag on after Europe's top judges told a lower court to re-examine the case.

"The General Court was required to examine all of Intel's arguments ... which the General Court failed to do", the European Court of Justice said in a statement issued to the press.

The EU's top court on Wednesday ordered a lower court to reconsider its rejection of an appeal by U.S. chip giant Intel against one of the EU's biggest-ever fines for breaking competition rules.

Historically, European courts have effectively rubber-stamped European Commission antitrust decisions and fines.

Police identify body as missing Temple student
Classes at the university's Philadelphia campus had just begun Monday, and it had been Burleigh's first week at Temple, he said. Philadelphia police say the body of a missing Temple University student has been found and a man is charged in her death.

"By undermining its competitors' ability to compete on the merits of their products, Intel's actions undermined competition and innovation", the Commission said at the time.

The outcome could have major implications for similar anti-trust cases that have been taken against other tech giants such as Google and Qualcomm.

After the ruling, Intel had tried to annul the decision or reduce the fine in General Court.

The General Court's new treatment of Intel's appeal is likely to add between two to four years to the process, making the case more than a decade old before it is finally decided.

Fromm leads Georgia to 31-10 season opener win
By halftime the home team was up 21-0. "We've got to have seven and eight and that's just not where we are right now". Fromm completed his first career touchdown pass to Javon Wims to give the Dawgs a 14-0 lead in the second quarter.

The lower court would have to examine on whether or not the rebates are actually restricting competition.

The CJEU has now ruled that the General Court was obliged to consider Intel's arguments on the point and to determine whether the Commission had applied the "as efficient competitor" (AEC) test correctly.

Intel also awarded payments to the electronics retail group Media-Saturn in order that the group would sell only those computers containing Intel's x86 CPUs.

The General Court in its 2014 ruling upheld the European Commission's 2009 decision but previous year a court adviser recommended backing Intel's arguments.
