While the world doesn't know and may never know how close the jurors in the Bill Cosby trial came to reaching a verdict, one alternate juror broke his silence Monday. Juror identity has been, and must continue to be, public in order to ensure fairness and promote public trust in the judicial system.

"The key to retrying a case is to do it differently the second time, because the defense expects you to do it the same way", said Constand's lawyer, Dolores Troiani. O'Neill has so far resisted requests by the media to release the names of the jurors.

Cosby, the actor and comedian once known as "America's Dad", was charged with three felony counts of aggravated indecent assault stemming from Andrea Constand's allegations that he drugged and violated her at his suburban Philadelphia home. The prosecution believes if the names of jurors are released and subject to mass media inquiries, it could make it more hard when the next jury is picked. While each juror is allowed to talk publicly about his/her own conclusions, none of them are allowed to reveal any of their fellow jurors' respective decisions or sidings.

Cosby's career and good-guy image were already in tatters by the time his chief accuser took the witness stand, and the prosecution's decision to pursue a second trial keeps him in legal limbo.

Judge Steven O'Neill, who presided over the Cosby trial, has yet to rule on the release of the names.

Constand, now 44, initially went to police about a year after she said Cosby assaulted her, but a prosecutor declared her case too weak to bring charges.

Jurors were selected in Pittsburgh because of concerns about the jury pool in Montgomery County being tainted by intense pre-trial publicity.

The 12 main jurors were advised by the judge not to speak out about the trial because Cosby will eventually be retried.

Mike McCloskey told a Pittsburgh radio station that he had served as an alternate and would have voted to convict Cosby.

Cosby, 79, has pleaded not guilty to drugging and molesting Andrea Constand in 2004. However, the six alternates listened to all of the testimony, in case a juror had to be excused for illness or another reason.

The names of the jurors who failed to reach a verdict in Bill Cosby's sexual assault trial have not been made public, but the judge could revisit the issue as early as Monday.

Attorney Eli Segal of Pepper Hamilton LLP, representing the media organizations, argued that the names of jurors is of "extraordinary public importance" and that news outlets have a First Amendment right to it.

"Thank you for the outpouring of love & kindness & support". Authorities reopened her complaint in 2015 after learning Cosby had testified in her lawsuit to giving various women wine, pills or even quaaludes before sex.
