Lawsuit: Man deported after being part of protection program

The DACA policy, launched by the Obama administration in 2012, protects persons - often called "DREAMers" - brought into the US during their youth from deportation and provides them with the right to work legally.

The Department of Homeland Security, U.S. Customs and Border Protection and United States Citizenship and Immigration Services didn't immediately respond to NewsHour requests for comment.

Montes' suit says he came to this country when he was 9 years old, and had been visiting a friend in Calexico, Calif., in mid-February and walking toward a taxi stand when he was approached by an officer from U.S. Customs and Border Protection who asked him for identification.

He came to the USA when he was 9 years old and since 2014 has been able to legally live and work in the country under the Deferred Action for Childhood Arrivals, or DACA, program, his attorneys said. Montes was not carrying his ID, which would have proved his DACA status, and agents refused to let Montes retrieve it, according to the report.

Even so, DACA enrollees are being targeted by immigration authorities.At least 10 are in federal custody, according to United We Dream, an advocacy organization made up of DACA enrollees and other young immigrants. According to USA Today, Montes climbed the border fence into the US and was questioned and sent back again to Mexico.

In Jackson, Mississippi, a young woman said she was detained after speaking at an immigration press conference. According to USA Today, Montes had carelessly left those documents in someone else's vehicle. He then worked two years picking crops in California and Arizona. "No one should have to file a lawsuit to find out what happened to them".

Trump has been evasive regarding Attorney General Jefferson Beauregard Sessions III's dislike of DACA.

Homeland Security said Montes' criminal record includes a theft conviction for which he received probation.

Montes has a record: three traffic violations and a shoplifting charge. He was also not given copies of the documents he signed, the lawsuit states. "I liked it there more than here".

"They detained me, they took me to a center, they asked me a lot of questions, and I signed a lot of papers", he said. Rather than continuing his education in the U.S., where he was studying welding at community college, Montes now works at a gas station and tortilla mill, dreaming of the day he can come home.
