Arkansas Attorney General Tries to Undo Judge's Orders on Executions”

Arkansas originally planned to execute eight inmates between Monday and April 27 and is appealing the ruling.

Inmates went to the 8th Circuit Court of Appeals overnight and asked judges to take their time reviewing transcripts and rulings, rather than complete their work in two days as the state has asked. Arkansas was set to execute the first two inmates by lethal injection on Monday night. Some states have barred the use of the drug, and courts have reached different decisions on what inmates would have to do to suggest alternative means of execution.

Hutchinson ordered eight executions in a span of 10 days, a controversial move as he did it because one of the state's lethal injection drugs - midazolam - was set to expire at the end of the month. Should this request be granted, the planned executions could be halted indefinitely, as a key drug in Arkansas's lethal injection cocktail expires at the end of April.

McKesson said: "The imminent danger that defendants (the state) would use McKesson's property and be unable to return it has been addressed by the federal court's preliminary injunction order".

The state's schedule of eight executions using midazolam between April 17 and 27 has been condemned by capital punishment opponents in the United States and overseas.

No state has ever put as many inmates to death in as short a period since the U.S. Supreme Court reinstated the death penalty in 1976.

"The unnecessarily compressed execution schedule using the risky drug midazolam denies prisoners their right to be free from the risk of torture", he said in a statement.

In her order, Baker said there was a significant possibility that the inmates could successfully challenge the state's execution protocol.

If the attorney had to rush out to file an emergency petition, it would deprive the inmate of a lawyer to witness the execution, Baker said.

On Saturday, Federal Judge Kristine Baker filed an injunction, stating the Arkansas executions violated the death row inmates 8th Amendment Rights. The company, along with other pharmaceutical makers, objects to its drug being used in executions.

A spokesman for the governor said it was unclear how the schedule of executions would proceed if a higher court allows them to proceed. McKesson claimed Arkansas improperly used medical credentials to obtain the vecuronium bromide and wants the product returned.

Earlier in the day, Rutledge's office also filed an emergency petition seeking to have the Arkansas Supreme Court throw out the restraining order issued Friday evening by Griffen in a lawsuit filed Friday by McKesson Medical-Surgical Inc., a DE drug company. A state judge Friday directed Arkansas to not use its current supply of vecuronium bromide pending a hearing Tuesday on whether it was obtained properly, though McKesson said Saturday that, with Baker's stays, it no longer needs the hearing.

In another weekend filing, Rutledge asked the Arkansas Supreme Court to reconsider its decision to stay the Monday execution of Bruce Earl Ward, whose attorneys argue is a paranoid schizophrenic incapable of comprehending his death.

Baker had said that while the Supreme Court has made reference to evolving standards, particularly when "punishments are so disproportionate as to be cruel and unusual", the Arkansas death row inmates were unlikely to prevail. She also noted that the execution team did not have antidotes on hand in case there was trouble with any of the drugs.

Baker's ruling added to a list of roadblocks for the state, following a stay of execution of another inmate, 24 hours earlier.
